Service Commercial APAC > Commercial Management Office APAC > Contract Management Professional
The Service Commercial Department APAC is overall responsible for improving the continuous and profitable business growth in Service across Asia Pacific (APAC) by selling service solutions for Renewable Energy assets to both new and existing customers.
The different service solutions are typically relating to one of the following business areas:

Long-term Operations & Maintenance agreements (Maintenance Contracting)

Transactional sales of Parts & Repair solutions (Parts & Repair)
-
Sales of upgrades, performance improvement & end-of-life solutions (Fleet Optimization)
Target customers are all investors, owners & operators of Renewable Energy assets and especially Wind Turbine Generators (Vestas & non-Vestas) in the APAC region. The main markets of the ASP region consist of Australia & New Zealand, India, Japan as well as Greater Asia, including the markets of South-East Asia (Vietnam, Thailand, Philippines, Indonesia, Taiwan) as well as China, Mongolia and South-Korea.
Responsibilities

Effectively build contract management capabilities, developing well integrated legal, commercial and contract management standards practices on contractual terms and obligations

Legal SME to Contract Management activities with understanding of contractual terms and clauses and its implications commercially, operationally and legally

Ensuring appropriate understanding of all the contractual terms entered with different customers

Support the contract approval process with region legal, assigning and obtaining required approvals and storing the contracts as required by local legislation

Providing legal commercial contractual support to internal stakeholders in the correct understanding and interpretation of contract clauses and handling of major claims

Facilitating continuous improvement of contract digitalization process from start to completion utilizing appropriate templates and procedures
Key Tasks:

Support Vestas commercial and operational colleagues where required (e.g., CSMs, Service Sales, development team, project managers, construction managers and service site managers) by interpreting contractual provisions in context of situation; identify possible contractual approaches and negotiating tactics to avoid or resolve customer disputes; and enable carry out the chosen strategy through drafting letters, notices and amendments. (else done by CSM)

Develop and maintain contracts database that captures life-cycle requirements for easy reference and management of operational and commercial obligations. (in alignment with Contract Administrator)

Where required, apply legal understanding in a commercial context to enable solve commercial issues in the most favorable way, participating in direct customer conversations and negotiations, as part of coordinated account team or ad hoc team to resolve specific issues. (else done by Service Sales and CSM/ CRM)

Ensure that all contracts and other legal instruments are consistent with Vestas internal guidelines for acceptable commercial commitments and other risk policies.

Review existing contracts for lessons learned, and direct that input to Sales and Service Sales teams to support negotiation of new sales and service agreements. Review and provide timely input on draft agreements during closing process. Support the handover of closed contracts from Sales to Service and Construction teams.

Develop and maintain very effective professional working relationship and iterative dialogue with Vestas Sales, Legal, Construction, Development, Finance and other departments.

Initiate internal process improvements necessary to support job requirements, including document management and reporting tools.

Identify opportunities to create mutual value for Vestas and customers while protecting Vestas profitability and risk need
Qualifications
-
Bachelors / Masters in Law or Business Administration with relevant commercial experience or professional contract management affinity
-
13+ years of experience in related or similar work in Energy sector or Industrial sector

International experience during educational or professional career preferred Experience of customer management & stakeholder management
-
Skilled communicator with the ability to exchange complex information with clarity

Good skills in English, both oral & written
